介護休規程

 

第1条(目的)

本規程は、従業員就業規則第35条の2に基づき、従業員が介護休および介護勤務等を取得する場合の取扱いについて定める。

 

第2条(介護休の適用対象者)

要介護状態にある家族を介護するために申し出た従業員に対して、この規程に定めるところにより、介護休を取得できる。

A   前項の要介護状態にある家族とは、負傷、疾病または心身の障害により、10日間以上の期間にわたって常時介護をする次の者をいう。

1.配偶者

2.父母

3.子

4.配偶者の父母

5.祖父母、兄弟姉妹、または孫のうち社員と同居し、かつ扶養されている者

6.上記以外の家族で会社が認めた者

B   前項にかかわらず、次の従業員には介護休を適用しない。

1.従業員のうち、期間を定めて雇用される者

2.労使協定により、介護休の対象から除外した者

 

第3条(介護休の期間)

介護休は、対象家族1人につき、連続する3ヵ月範囲(介護休開始予定日の翌日から起算して3ヵ月を経過する日をいう)内で、第4条の介護休取得・変更・撤回申出書(以下、介護申出書と略す)に記載された期間とする。

A   ただし、同一の家族について第14条に規定する介護勤務等の適用を受けた場合は、いずれか先に適用を受けた日の初日の翌日から起算して3ヵ月が経過する日までとする。

B   前2項にかかわらず、介護休終了後3年が経過すれば、当該同一の家族についても第2条に基づき介護休を取得できる。

 

第4条(介護休の申出の手続き)

介護休をすることを希望する者は、原則として介護休を開始しようとする日(以下「介護休開始予定日」という。)の2週間前までに、介護休申出書を会社に提出するものとする。

A   申出は、特別な事情がない限り、対象家族1人につき1回とする。

B   会社は、介護休申出書を受けとるに当り、必要最小限度の各種証明書の提出を求める。

C   介護休申出書が提出されたときは、会社は速やかに当該申出者に対し、介護休等承認通知書を交付する。

 

第5条(介護休の申出の撤回)

申出者は、介護休開始予定日の前日までは、介護休の申出を撤回できる。

A   申出を撤回した者については、特別な事情がない限り、当該家族に係る再度の申出は1回までとする。

B         介護休開始予定日の前日までに、申出に係る家族の死亡等によって申出者が介護する必要がなくなった場合には、介護休の申出は最初からなかったものとみなす

C         前3項による撤回をする場合、申出者は遅滞なく介護休申出書を提出しなければならない。

 

第6条(介護休の期間変更)

介護休をしている従業員は、育児・介護休業法に定めるところにより介護休を終了しようとする日(以下「介護休終了予定日」という。)の繰下げ変更を行うことができる。その場合は介護休終了予定日の2週間前までに申し出なければならない。この場合において、介護休開始予定日から変更後の介護休終了予定日までの期間は3ヵ月の範囲を超えないことを原則とする。

A  介護休をしている従業員は、介護休期間を短縮して復帰することもできる。その場合は復帰の2週間前までに申し出るものとする。会社がこれを適当と認めた場合には、速やかに本人に通知する。

B   前2項の変更を行うときは、介護休申出書により会社に申し出るものとする。

 

第7条(介護休の終了)

次の各号のいずれかに該当するとき、介護休は自動的に終了する。その終了の日は各号に掲げる日とする。

1. 家族の死亡等によってその家族を介護しないことになった場合はその事由発生日

2. 申出者について、産前産後休、育児休、または新たな介護休が始まった場合は開始日の前日

A   前項の事由が発生したときは、従業員は介護休申出書により、遅滞なくその旨を会社に届出なければならない。

 

 

第8条(給与、賞与の取扱い)

介護休を取得してから当初3日目までは所定労働時間勤務した場合に支給される通常の賃金を支給するが、当該4日目以降は賃金を支給しない。その場合の給与の減額方法は給与規則第31条(休暇を取得した日の賃金)6項で定める方法による。

A   賞与については、通常の支給日に支給するが、その査定対象期間に介護休の期間が含まれていれば、給与支給規則第35条(受給資格)で定める方法により減額する。

B   退職金算定の際の勤続年数には介護休期間を算入する。

 

第9条(社会保険料の取扱い)

給与が支払われない月があるときは、その月における社会保険料の被保険者負担分を一旦会社が立て替えて納付する。会社はその納付額を復帰後1月以内に本人に請求する。

A   介護休の期間中に退職する場合、被保険者は遅滞なく会社が立て替えた保険料を支払わなければならない。

B           前2項の返済方法については本人と相談の上決定する。

C           法律により、社会保険料の被保険者負担分が免除される期間については前3項の限りではない。

 

第10条(住民税の取扱い)

本人から特に申出がない限り特別徴収し、会社が別途立て替える

A   返済方法については本人と相談の上決定する。

 

第11条(定期昇給の取扱い)

定期昇給は介護休の復帰後に行う。その場合、査定対象期間の中に介護休の期間があるときは、給与規則第15条−2(昇給額の算出方法)に定める方法で昇給額を算出する。

 

第12条(昇格の取扱い)

昇格は給与支給規則第16条―2(昇格の取扱い)を準用する。

 

第13条(復職後の取扱い)

介護休後の勤務は、原則として原職または原職相当職で行うものとする。ただし、本人の希望や事業の変更等のやむを得ない事情がある場合には、職務の変更を行うことがある。

 

第14条(年次有給休暇の取扱い)

年次有給休暇の権利発生に関わる出勤率の算定に当っては、介護休を取得した日は、出勤したものとみなす。

 

第15条(介護勤務等)

第2条第1項の介護休適用対象者は、介護休申出書を会社に提出し、次のいずれかの短時間勤務制度(以下、介護勤務等と略す)の適用を受けることができる。

ただし、勤務時間等については本人と相談の上決定する。

1.介護勤務    =1日当りの所定労働時間を最大2時間短縮できる制度

2.1日介護休暇=1月のうち最大5日の介護休暇を取得できる制度

A   前項にかかわらず、労使協定により、本制度の対象から除外することとした者については適用しない。

B   介護勤務等の適用期間については第3条の規定を準用する。 

C   申出の手続きについては、第4条から第7条までの規定を準用する。

D   年次有給休暇の取扱いについては、第14条の規定を準用する。

 

 

第16条(介護勤務等の期間の給与等の取り扱い)

介護勤務期間中の給与については、給与規則第28(所定労働時間勤務しなかった日の賃金)で定める方法により減額する。ただし、1日介護休暇については、第8条第1項の方法で減額する。

A   賞与は、その査定対象期間に介護勤務等の適用を受ける期間がある場合、給与規則第32(出退勤による査定)第3項で定める方法により減額する。

B   定期昇給、昇格および退職金の算定に当っては、介護勤務等の適用を受ける期間は通常の勤務をしているものとみなす。

C   前条第1項第1号の適用期間中はフレックスタイム制を適用しない。

 

第17条(深夜業の免除)

第2条の介護休適用対象者は、事業の正常な運営を妨げる場合を除き、深夜業の免除を求めることができる。

A   前項にかかわらず、次の従業員は深夜業の免除を請求することはできない。

1.日々雇用される者

2.勤続1年未満の従業員

3.深夜において常態として対象家族の介護ができる16歳以上の家族と同居している者

B   第1項の免除を希望する者は、免除を受ける期間の初日と末日を指定し、期間初日の2週間前までに深夜業免除等請求書により請求しなければならない。

C   前項の深夜業免除期間は1回当り最大6ヵ月間とするが、第1項に該当する限り何度でも請求できる。

 

第18条(深夜業免除の解除・終了)

前条の免除の承認を受けた者は何時でも免除を解除できる。この場合は、遅滞なくその旨を前条第3項の請求書により、会社に通知しなければならない。

A   第7条(介護休の終了)第1項の事由が生じた場合には、当該制限期間は自動的に終了する。この場合も、前項と同様に通知しなければならない。

 

第19条(法令との関係)

本規程において、この規程に定めのないことについては、育児・介護休業法その他法令の定めるところによる。

Rules for Nursing Care Leave

 

Article 1          (Purpose)

These Rules are to regulate matters pertaining to nursing care leave and reduced working hours for nursing care taken by an employee pursuant to Article 35-2 of the Work Rules for Employees.

 

Article 2          (Employees Eligible for Nursing Care Leave)

1.  An employee who requests to take a leave to care for a family member in need of nursing care shall be eligible for a nursing care leave in accordance with the provisions of these Rules.

2.     A family member in need of nursing care as described in the preceding paragraph means any of the following individuals who are in need of constant care for a period of ten (10) days or longer due to an injury, illness or physical or mental disability:

(1)   The employee’s spouse:

(2)   The employee’s parents;

(3)   The employee’s children;

(4)   The parents of the employee’s spouse;

(5)   Grandparents, brothers, sisters, and grandchildren who are supported by and live with the employee; or

(6)   A family member other than any of the foregoing for whom the Company has given approval.

3.     Notwithstanding the preceding paragraph, the following employees shall not be entitled to take nursing care leave:

(1)   Employees who are hired for a specified period of time; and

(2)   Employees excluded from eligibility for nursing care leave pursuant to a labor-management agreement.

 

Article 3          (Period of Nursing Care Leave)

1.     Nursing care leave shall be for a period stated in a written application for taking, altering, or withdrawing nursing care leave (hereinafter abbreviated as "notice of nursing care leave") under Article 4 hereof not exceeding three (3) consecutive months (meaning the period from the scheduled starting date of the leave until the day on which three (3) months shall have elapsed, counting from the day after the said starting date per person in need of nursing care).

2.     However, when the employee is granted the application of reduced working hours for nursing care under Article 15 below with respect to the same family member, the period in the preceding paragraph shall be up to the day on which three (3) months shall have elapsed from the day after the date on which the said reduced working hours or nursing care leave was first applied, whichever comes earlier.

3.  Notwithstanding the preceding two paragraphs and upon expiration of three (3) months after the termination of a nursing care leave, an employee may be eligible for another period of nursing care leave with respect to the same family member.

 

Article 4          (Procedures to Request Nursing Care Leave)

1.     An employee desiring to take nursing care leave shall, in principle not later than two (2) weeks prior to the date on which he/she proposes to start his/her nursing care leave (hereinafter referred to as the "scheduled starting date of the leave"), submit a notice of nursing care leave to the Company. 

2.     Unless some special circumstance applies, an employee may request only one nursing care leave per eligible family member.

3.     Upon receipt of an employee's notice of nursing care leave, the Company may require the employee to submit the irreducible minimum number of necessary certificates.

4.     Upon receipt of a notice of nursing care leave, the Company shall promptly issue a notice of acceptance of the nursing care leave to the employee in question.

 

Article 5          (Withdrawal of a Request for Nursing Care Leave)

1.     An employee who has requested a nursing care leave may withdraw that request by so notifying the Company not later than the day before the scheduled starting date of the leave.

2.     Once an employee has withdrawn his/her request for a nursing care leave, he/she may make the request again only once for the same family member unless some special circumstance merits such request.

3.     A request for a nursing care leave shall be deemed not to have been made if, after the submission of an application therefor and before the scheduled starting date of the leave, the family member in question dies or otherwise ceases to require or be able to benefit from the nursing care that the employee was intending to provide. 

4.     An employee intending to withdraw his/her request for a nursing care leave under the preceding three (3) paragraphs shall submit a notice of nursing care leave to the Company without delay.

 

Article 6          (Alteration of the Period of Nursing Care Leave)

1.     An employee on a nursing care leave may, pursuant to the provisions of the Childcare and Nursing Care Leave Law, alter the proposed date on which the nursing care leave will finish (hereinafter referred to as the "scheduled completion of the leave") by changing it to a later date if he/she files an application therefor with the Company not later than two (2) weeks before the scheduled completion of the leave.  In any such case, the period from the scheduled starting date of the leave until the scheduled completion of the leave after the alteration shall not, in principle, exceed three (3) months.

2.     An employee on a nursing care leave may shorten the period of the nursing care leave and return to work if he/she gives the Company notice thereof not later than two (2) weeks before the proposed date of his/her return to work.  The Company shall, if it deems the employee's request reasonable, promptly give notice to that effect to the employee. 

3.     An employee intending to effect alteration under the preceding two paragraphs shall notify the Company by submitting a notice of nursing care leave.

 

Article 7          (Termination of Nursing Care leave)

1.     If either of the following events occurs, a nursing care leave shall automatically terminate as of the day so stated:

(1)   When the family member in question dies or the employee otherwise ceases to provide nursing care for the family member for whom the leave was taken, the day of the occurrence of the event in question; or

(2)   When a maternity leave, childcare leave or another nursing care leave has begun prior to the date that the nursing care leave in question was scheduled to finish, the day before the starting date of the new leave.

2.     If an event set forth in the preceding paragraph occurs, the employee in question shall so notify the Company without delay by submitting a notice of nursing care leave.

 

Article 8          (Treatment of Salary and Bonus)

1.     Regular salaries payable to employees who have worked scheduled working hours shall be provided for the first three days of a nursing care leave, and thereafter no salary shall be paid.  In any such case, salary shall be decreased in accordance with the method prescribed in Article 31 (Salaries and Wages for Days on Leave) Paragraph 6 of the Rules for Salary Payments.

2.     A regular bonus due to the employee shall be paid on the scheduled date of payment thereof; provided that the amount of the bonus shall be decreased in accordance with the method prescribed in Article 31 (Eligibility for Payments) of the Rules for Salary Payments if the bonus appraisal period includes all or part of a nursing care leave.

3.     The period of a nursing care leave shall be included in the number of service years for the purpose of determining retirement benefits.

 

Article 9          (Treatment of Social Insurance Premiums)

1.     An employee's share of social insurance premiums for any month without salary payment shall be paid by the Company on behalf of the employee.  The Company shall request the employee to repay the amount it has so paid within one (1) month after he/she returns to work. 

2.     If the employee leaves the employment of the Company during a nursing care leave, he/she shall repay the insurance premiums paid by the Company on his/her behalf without delay.

3.     The method of repayment under the preceding two paragraphs shall be determined upon consultation between the Company and the employee.

4.     The preceding three paragraphs shall not apply to any period during which the employee's share of social insurance premiums are exempted by law.

 

Article 10        (Treatment of Inhabitant Tax)

1.     Unless otherwise expressly requested by the employee in question, residence tax shall be subject to special collection and the Company shall pay the applicable amount on his/her behalf separately.

2.     The method of repayment shall be determined upon consultation between the Company and the employee.

 

Article 11        (Treatment of Periodic Pay Raise)

The Company’s periodic pay raise shall be effected after an employee returns to work from nursing care leave.  In any such case, if the pay raise appraisal period includes all or part of the nursing care leave, the amount of the raise shall be calculated in accordance with the method prescribed in Article 15-2 (Calculation of the Pay Raise) of the Rules for Salary Payments.

 

Article 12        (Treatment of Promotion)

Article 16-2 (Treatment of Promotion) shall apply mutatis mutandis to promotion.

 

Article 13        (Treatment after Reinstatement)

As a general rule, employees shall be assigned to their original posts or equivalent posts after returning from nursing care leave; provided that the Company may effect changes in posts and duties if the employees so desire, or if there has been a change of business or other compelling circumstance.

 

Article 14        (Treatment of Annual Vacation with Pay)

The period of a nursing care leave shall be deemed a period of attendance when calculating the number of annual paid vacation days the employee has earned.

 

Article 15        (Reduced Working Hours for Nursing Care)

1.     An employee eligible for nursing care leave under Article 2 Paragraph 1, may be allowed to work under either of the following systems of reduced working hours by submitting a notice of nursing care leave:

(1)   Reduced working hours for nursing care:

        A system allowing eligible employees to reduce their scheduled working hours by up to two (2) hours per day.

(2)   A whole day off for nursing care:

        A system allowing eligible employees to take up to five (5) days off for nursing care per month.

2.     Notwithstanding the preceding paragraph, employees excluded from eligibility for this system pursuant to a labor-management agreement shall not be entitled to work reduced hours under this system. 

3.     The provisions of Article 3 shall apply mutatis mutandis to the period during which the reduced working hours system is applied.

4.     The provisions of Articles 4 through 7 shall apply mutatis mutandis to procedures for requesting the application of the system.

5.  The provisions of Article 14 shall apply mutatis mutandis to the treatment of annual vacation with pay.

 

Article 16        (Treatment of Salary, etc., during Reduced-Working-Hour Period)

1.     Salary shall be decreased in accordance with the method prescribed in Article 28 (Salaries and Wages for Days on Which Scheduled Working Hours Were not Worked) of the Rules for Salary Payments with respect to the period of reduced working hours and the method described in Article 8 Paragraph 1 hereof with respect to whole days off for nursing care.

2.     When a bonus appraisal period includes a period during which reduced working hours system has been applied, the amount of the bonus shall be decreased in accordance with the method prescribed in Article 32 (Appraisal by Arriving and Leaving Office) Paragraph 3 of the Rules for Salary Payments.

3.     The period during which the reduced working hours system is applied shall be deemed a period of regular attendance in calculations relating to periodic pay raises, promotions, and retirement benefits.

4.  A flexible working hours system shall not be applicable when the employee is working under the system provided in Article 15 Paragraph 1 Item (1).

 

Article 17        (Exemption from Night Work)

1.     An employee eligible for a nursing care leave under Article 2 may request exemption from night work except when such exemption is deemed to prevent the normal operation of the Company's business.

2.     Notwithstanding the preceding paragraph, the following employees shall not be entitled to request exemption from night work:

(1)   Employees hired by the day;

(2)   Employees with less than one (1) year of service; and

(3)   Employees who live with a family member aged 16 or older who can, under normal conditions, provide nighttime nursing care to the eligible family member in question.

3.     An employee desiring to request exemption under Paragraph 1 shall file a written request for night work exemption with the Company, specifying the first day and the last day of the period of such exemption, not later than two (2) weeks prior to the first day of the said period.

4.     The period of exemption from night work under the preceding paragraph shall not exceed six (6) months at a time, but employees may file request therefor repeatedly for an unlimited number of times as long as they remain eligible under Paragraph 1.

 

Article 18        (Cancellation/Termination of Exemption from Night Work)

1.     An employee who is granted approval for exemption under the preceding article may cancel such exemption at any time, in which case the employee shall give notice thereof to the Company without delay on the same request form mentioned in Paragraph 3 of the preceding article.

2.     If any event set forth in Article 7 (Termination of a Nursing Care leave) Paragraph 1 occurs, the period of exemption shall automatically terminate, in which case the employee shall give notice thereof to the Company by the same method described in the preceding paragraph.

 

Article 19        (Relationship with Laws and Ordinances)

Matters that are not prescribed in these Rules shall be determined in accordance with the Childcare and Nursing Care Leave Law and other applicable laws and ordinances.

 

 

 

Supplementary Provisions

 

Article 1          (Enforcement)

These Rules shall come into force as from April 1, 2002.
